Entitlement and deadlines
Students who live independently of their parents and do not receive funding for studies in accordance with the Federal Education and Training Assistance Act (Bundesausbildungsförderungsgesetz/BAföG) and are not, in principle, entitled to such funding (e.g. because they are taking a second degree or have changed their course) are entitled to receive accommodation allowance.
Students who do not receive funding for studies in accordance with BAföG because of their parents’ income, but are, in principle, entitled to such, are not entitled to receive accommodation allowance. Accommodation allowance is not granted retroactively, but starting from the month of receipt of the formal application.
Proof
The student must prove that he/she has moved out of the parents' family home, not just temporarily, as a requirement for receiving this allowance. In principle, married students, applicants with children and students who have completed vocational training and have worked in their trained profession for longer periods fulfil this requirement.
If the parents’ family home does not offer enough living space for the independent student, this also serves as proof of entitlement to accommodation allowance. The conversion of a former child’s bedroom into e.g. a study for the parents is not recognised by the accommodation allowance office (Wohngeldstelle) as a justified reason for the lack of living space. A disagreement with parents is not, in principle, an adequate reason to assume the student’s complete separation from the parents' household.
The subject of the disagreement must also be proved following the application for maintenance. If maintenance is provided exclusively or primarily by the parents, temporary absence from the parent’s household will be assumed. In this case, the student is not entitled to accommodation allowance.
